Aswaqfy Terms of Use
Version 2.2 · Last updated 1 November 2026 · Applies to everyone who uses Aswaqfy
This document is also available in Arabic. If the two versions differ, the Arabic version prevails.
By creating an account or using the Aswaqfy app or website, you agree to these Terms. If you do not agree, please do not use Aswaqfy.
1. Who we are
Aswaqfy (أسواقفاي) is an online marketplace operated by Al Raqeem Al Hadith (الرقيم الحديث), a sole proprietorship registered in the Sultanate of Oman. In all Aswaqfy documents, "Aswaqfy", "we" and "us" mean Al Raqeem Al Hadith.

2. What Aswaqfy does
Aswaqfy connects customers with independent vendors in Oman. Vendors list and sell their own products. Aswaqfy provides the platform, the checkout and Buyer Protection.
Aswaqfy is not the seller, manufacturer or owner of products listed by vendors. Each sale is a contract between the customer and the vendor named on the product page and the order.
Aswaqfy acts as the vendor's agent for one limited purpose: collecting the customer's payment and releasing it under the Buyer Protection Policy. Aswaqfy does not offer wallets, stored balances or any payment service to customers.
3. Documents that apply to you
- Everyone: these Terms of Use and the Privacy Policy.
- Customers: the Customer Terms of Purchase, Buyer Protection Policy, Returns, Refunds and Cancellations Policy, Delivery Policy, and Complaints and Disputes Policy.
- Vendors: the Vendor Agreement, Vendor Fees and Payouts, Prohibited and Restricted Items, and Listing, Promotion and Review Rules. The customer-facing policies also bind vendors.
If two documents conflict, the document written for that specific topic prevails over these Terms. No document reduces your rights under Omani law.
4. Your account
- You must be at least 18 years old and legally able to enter into contracts.
- Give accurate information and keep it up to date. Use your own name and a phone number you control.
- Keep your login details private. You are responsible for activity on your account. Tell us at once if you think someone else has used it.
- One person may hold one customer account. A vendor may hold one store per licence unless we agree otherwise in writing.
5. Acceptable use
You must not:
- break any law of the Sultanate of Oman;
- give false information or pretend to be someone else;
- place fake orders, write fake reviews or make false Buyer Protection claims;
- harass, threaten or insult other users or our staff;
- post content that is offensive to public morals or to Islamic values;
- copy, scrape, reverse-engineer or overload the app, or try to get around its security;
- use Aswaqfy to arrange a payment outside the platform for an order placed on it.
6. Content you post
You keep ownership of reviews, photos and messages you post. You give Aswaqfy a free, non-exclusive licence to display, resize and translate that content in the app and in Aswaqfy's own marketing while it remains on the platform, and for a reasonable time afterwards.
Your content must be lawful, accurate and your own, or used with permission.
We may remove content that breaks these Terms or the law.
7. Aswaqfy's name and property
The name أسواقفاي and Aswaqfy, the logo, the mascot, the app's design and its software belong to Al Raqeem Al Hadith. A trademark application for أسواقفاي has been filed with the Ministry of Commerce, Industry and Investment Promotion. You may not use any of them without our written permission.
8. Reporting an illegal or infringing listing
Anyone may report a listing that is illegal, counterfeit or infringes their rights. Send the listing link, the reason and any evidence to support@aswaqfy.com or WhatsApp. We review reports within 5 working days, may remove the listing, and tell the vendor why.
9. Availability
We work to keep Aswaqfy available but cannot promise it will always be uninterrupted or error-free. We may change, pause or remove features. Planned maintenance will be announced in the app where possible.
10. Suspension and closing an account
You may close your account at any time from settings or by contacting us. Open orders must be completed, cancelled or refunded first.
We may restrict, suspend or close an account for a breach of these documents, suspected fraud, a legal requirement, or a risk to other users. We will tell you the reason unless the law or an investigation prevents it.
You can object to a suspension through the Complaints and Disputes Policy.
Money held for open orders is dealt with under the Buyer Protection Policy, even if an account is closed.
11. Our responsibility
We are responsible for running the platform with reasonable care and for handling payments as the Buyer Protection Policy describes.
Vendors are responsible for their products, descriptions, delivery and the guarantees the law requires of sellers. We help customers enforce those rights through the Complaints and Disputes Policy.
We are not liable for indirect losses, loss of profit or business, or delays caused by events outside our reasonable control, such as network outages, bank or payment-provider failures, extreme weather or government action.
Apart from money we hold for an order, our total liability to you is limited to the greater of OMR 50.000 or the fees you paid Aswaqfy in the 12 months before the claim.
Nothing in these Terms limits liability that Omani law does not allow to be limited, including liability for fraud or gross negligence, or your rights under the Consumer Protection Law (Royal Decree 66/2014).
12. Changes to our documents
We may update these Terms and the other Aswaqfy documents. We will tell you about important changes in the app, by WhatsApp or by email at least 15 days before they take effect. Vendors receive 30 days' notice of changes to fees.
Changes never apply to orders placed before they take effect.
If you do not accept a change, you may close your account before it takes effect.
13. Electronic communication
You agree that we may communicate with you in the app, by SMS, WhatsApp or email. Agreements you accept electronically on Aswaqfy have the same legal effect as signed paper agreements under the Electronic Transactions Law (Royal Decree 39/2025).
14. Law, language and disputes
These Terms are governed by the laws of the Sultanate of Oman.
Please raise any problem with us first through the Complaints and Disputes Policy. This does not affect your right to complain to the Consumer Protection Authority or to go to the competent courts of the Sultanate of Oman.
These Terms are published in Arabic and English. If the two differ, the Arabic version prevails.
15. Fees
A service fee of 3% of the order total (products plus delivery), with a minimum of OMR 0.100, is added to every order and shown clearly before payment. The service fee is refunded in full if the order is cancelled by the vendor or by Aswaqfy, or if the item is damaged, wrong, or not delivered. It is not refunded when the customer returns an item because they changed their mind.
